Are you sure about your computer forensics expert?

It's about time a service was offered to clients who are professionally involved with a computer forensics investigator, examiner, expert, evaluator, consultant, technician, analyst, etc.  They come with a variety of titles.  If you don't know that much about computers, E-discovery, digital evidence, chain of evidence, hidden data, and other concepts in computer forensics then you can be victimized by a growing number of men and women who are claiming to be computer forensics consultants.  Often you are stuck when the "other" side of your case is using a computer forensics expert witness.

If you are unable to thoroughly choose a computer forensics expert or if you are on a civil or criminal case where the "other" side is using computer forensics then you will need the assistance of someone who can tell you if the computer forensics expert is qualified or not.  We have found computer forensics experts who are practicing with false credentials, illegal businesses, contrived resumes, and more.  Some boast of having certifications that are not government sanctioned.  Some certifications were invented just for the certifier to make a profit and give some false importance to someone who paid for the certificate.

The problem is here because of the nice consulting fees that computer forensics experts are demanding.  Also, the computer forensics investigation business is growing beyond all expectations.  Hundreds of dollars per hour are not uncommon fees that computer forensics experts charge with large upfront retainers.  It is rather easy to set up a "computer forensics shop" and hang a nice "shingle" and web site advertising miracle techniques to win your case with computer evidence.

You will find the unqualified computer forensics expert witness with a step-wise process of background investigation techniques as should be done for any expert witness.  The evaluation of a computer forensics expert witness takes a computer forensics expert investigator to make the case winning discovery that the computer forensics expert witness was unqualified, terribly wrong, inaccurate, and/or just plain illegally practicing with possibly an undiscovered criminal history.

We recommend hiring Stockham Computer Forensics to hunt down the unqualified the computer forensics expert.  We have been in the foundation of computer forensics development since 1994 with computer forensics investigation work experience from over 30 years of full-time law enforcement.  Mr. Stockham has qualified in court on a variety of cases including homicides.  He has been cross-examined by the best.

Here is what will happen when you "catch" an unqualified computer forensics expert witness.  I recommend catching them during the discovery and/or deposition stage of your investigation, civil or criminal.  It's nice to "catch" one under oath with some very important questions that must be asked that have proved invaluable in revealing the unqualified expert, in "their own words" and "their own technical jargon."   You will get a disqualification and probably a civil or criminal prosecution against the expert that is caught.  The digital evidence is then tainted and weakens the case for the side that hired the unqualified expert.  The case can settle in your favor just because you double-checked the expert.

Waiting until trial or some hearing could cause the judge to ask the question:  "How long have you known about this expert witness disqualification issue!?"  Holding the issue in order to "ambush" the unqualifed computer forensics expert witness in trial or other late-stage hearing is a debatable legal tactic.

The following summary is just one example of a fraudulent computer forensics expert published in the "Fresno Bee" Fresno, CA:  Expert witness, Computer Forensics Investigator accused of lying.

Man retained by two Fresno attorneys faked his résumé, agents say.

James Earl Edmiston, it appears, fooled a lot of very smart people.
Somehow, the Long Beach resident earned a reputation as an expert in
computer forensics, and backed it up with a sterling résumé that
featured degrees from the California Institute of Technology,
University of California at Los Angeles and other institutions of
higher learning. He had been an expert witness and testified in court before judges,
lawyers and prosecutors.

Recently, he was retained by Fresno attorneys Richard Berman and Eric Schweitzer to work on two local cases.

"I've checked out guys in the past that were flaky, but this guy's
credentials were impeccable," Berman said.

But is was all a lie according to Federal Officials.  (Full story at Fresno Bee Online)
